Alaska House Strikes a Blow for the Second Amendment

Pro-gun bill now goes to Senate

By a stunning 31-5 vote, the Alaska House passed House Bill 69 -– a bill which would outlaw unconstitutional violations of the Second Amendment by federal, state, or local officials.

House Bill 69 has three parts:

* The first part (sections 2, 3, and 4) would prohibit the federal government from regulating firearms made and possessed wholly within the state of Alaska.  In

* The second part (section 5(f)) would prohibit Alaska’s state and local officials from enforcing unconstitutional gun bans and registration systems.

* The third part (section 5(g)) would make it a felony for a federal official to try to enforce an unconstitutional gun ban or system of registration in the state of Alaska.

Although some lawyers are whining that “federal law trumps Alaska,” the fact is that the Constitution’s right to keep and bear arms trumps the federal government’s sleazy attempts to circumvent it.  Federal laws (such as 18 U.S.C. 241) correctly recognize that federal government law enforcement officials are not protected if they try to act unconstitutionally.

House members correctly decided that they would “let the courts sort it out.”

Now the measure moves to the state senate.  And it’s important that your state senator hear from you.

Dear Senator:

By a stunning 31-5 vote, the Alaska House passed House Bill 69 -– a bill which would outlaw unconstitutional violations of the Second Amendment by federal, state, or local officials in Alaska.

Now it’s time for the state senate to act.

House Bill 69 has three parts:

* The first part (sections 2, 3, and 4) would prohibit the federal government from regulating firearms made and possessed wholly within the state of Alaska.  In addition, the state attorney general would be authorized to defend Alaskans prosecuted by the federal government in violation of this provision.

241) correctly recognize that the federal government law enforcement officials are not protected if they try to act unconstitutionally.

House members correctly decided that they would “let the courts sort it out.”

Now the measure moves to the state senate.  When it comes before you, please support House Bill 69.

Sincerely,
